What Can Bankruptcy Do For You?
It can give you and your possessions immediate relief from creditors. Chapter 13 can stop home foreclosure and protect your home, it can stop auto repossession and protect your vehicle. Chapter 13 can stop evictions from your place of residence. Both Chapter 13 and Chapter 7 bankruptcy can release a garnishment of your wages or bank account. Both Chapter 7 and Chapter 13 can discharge older personal tax debt, and Chapter 13 can be a good, safe way to pay more recent tax debt and corporate tax debt. Many clients have used bankruptcy to improve their credit rating. In many cases credit scores can and do significantly improve and rebuild in as little as two years.
Chapter 13 and Chapter 7 can get you a big break on income tax debt. In general, tax debt that is more than 3 years old can be forgiven and discharged. The internal revenue code and the bankruptcy code rules on tax debt are complex but we know the rules and code and will be able to tell you how much of your taxes will be forgiven and how much you will have to pay. If you have tax debt to pay, there is no better way to pay it than under the protection of chapter 13. Unlike installment agreements, if you miss a payment in a chapter 13 case it will not default the case, and while you are under a case the IRS can take no action against you.
